Rules and Regulations
1. HOW TO ENTER: No purchase necessary. This contest ("Contest") is only open to fully accredited dentists who are licensed, by the relevant federal or provincial governmental authority or body, to practice dentistry anywhere in Canada ("Dentists"). Dentists must register on-line at www.Dentsply.ca/gold ("Website"), fully complete all of the requested information on the on-line form and submit a Gold Performance PIN numbers ("PIN Number"), which acts as an entry form or "ballot". All eligible persons who register for the Contest during the Contest Period (as hereinafter defined) will have their name automatically entered with a ballot into each of the two draws to win one of the Prizes (as hereinafter defined). The Contest sponsor is Dentsply Canada Ltd. ("Dentsply")
To Obtain a PIN Number. You require a PIN Number to enter this Contest. There are two ways to obtain a PIN Number:
- Commencing on March 24, 2009, specially marked packages of XP Bond, Xeno
IV, Esthet-X HD, Esthet-X Flow, Dyract Xtra, DyractFlow, TPH3, Ceram-X and
Prime & Bond NT with a Gold Performance Seal will be randomly
distributed to participating dealers throughout Canada. Purchase a
specially marked package of any of the above DENTSPLY products and
look for the Gold Performance sticker affixed to the outer package
to find your unique PIN Number;
OR
- No purchase necessary. To obtain a free PIN Number, while supplies last, mail a stamped, self-addressed envelope, to: DENTSPLY PIN NUMBER REQUEST: c/o 3H Communications Inc. 309 Church Street, Oakville, ON L6J 1N9. Limit of one request for a PIN Number per envelope. All requests for a PIN Number must be received by no later than March 1, 2010.
A PIN Number can only be used once to enter the Contest.
2. CONTEST PERIOD: To enter the Contest, Dentists must register their PIN Number on-line on the Website anytime between March 24, 2009 and 11:59 p.m. on March 24, 2010. ("Contest Period").
3. THE PRIZES: There are three (3) prizes ("Prizes") with each Prize being a trip for two (2) persons to Athens, Greece consisting solely of: (a) round trip economy class airfare for two (2) persons from the City of Montreal, Toronto or Vancouver, Canada, to the City of Athens Greece; (b) seven (7) nights standard hotel accommodations ("Accommodations") in one guest room for two (2) persons based upon double occupancy at a hotel in the City of Athens, Greece; and (c) transit upon arrival and departure to and from the Athens airport to the winner's hotel in Athens. The Accommodations shall be at a hotel selected by the winner from Dentsply's list of designated hotels, which may vary by the date and season in which the winner books and take his/her Trip. For greater certainty, some of Dentsply's designated hotels Accommodations may not be available to be selected by the winner depending on the date and season of the Trip. All other costs and expenses of any kind whatsoever including, without limitation, with respect to, relating to or in connection with the Trip are borne solely by the winner. For greater certainty, the Prize does not include transfers to and from any airports in Canada; gratuities; meals, food and beverages; taxes, including (but not limited to) Canadian and foreign departure taxes; gas; fuel surcharges, if applicable; travel insurance; travel documentation; all personal costs and expenses; and any other items, costs or expenses of any kind whatsoever; all of which shall be the sole responsibility of the Prize winner. Approximate retail value of each Prize is $7,000.00 (Cdn). If the cost and expense of the Prize exceeds the sum of $7,000.00 ("Prize Value"), the winner of the Prize shall be solely responsible for and shall pay any and all amounts relating to the Prize exceeding the Prize Value. For greater certainty, in no event or circumstance shall Dentsply and/or its advertising and promotional agencies (including, without limitation, 3H Communications Inc.), their related or affiliated companies, officers, directors, employees, consultants, agents and/or representatives or any of their heirs, executors, administrators, successors or assigns (hereinafter collectively the "Dentsply Group") be responsible for any costs or expenses of the Prize which exceeds the Prize Value.
4. CONTEST DRAWS: A selected entrant will be selected from among all eligible entries received in two (2) random draws. The first draw will be conducted on September 15th, 2009 in Oakville Ontario at approximately 10:30 a.m. and shall be for one (1) Prize. The second draw will be conducted on April 15th 2010 in Oakville at approximately 10:30 a.m. and shall be for two (2) Prizes.
The selected entrant will be notified by mail or telephone. To be declared a winner, the selected entrant must, within fourteen (14) days following attempted notification: (1) correctly answer a time-limited mathematical skill-testing question to be administered by telephone; and (2) sign a declaration, release and indemnity, in a form satisfactory to Dentsply, confirming compliance with the Contest rules, releasing the Dentsply Group, from any and all claims, actions, causes of actions, losses, liabilities, damages, costs and expenses ("Claims") which the selected entrant or winner may suffer or incur arising from or related to the Contest or receipt of or use of the Prize and indemnifying the Dentsply Group in respect of any Claims made arising from the selected entrant's participation in the Contest and/or his/her receipt or use of, and the person traveling with the winner's use of, the Prize. If the selected entrant fails to comply with the aforesaid conditions within the aforesaid 14 day period, he/she may be disqualified and the Prize may be awarded to another entrant by way of a further draw. No substitution for, or transfer of, the Prize by the selected entrant or winner will be allowed. A winner of a Prize shall be solely responsible for his/her own travel and health insurance with respect to the Prize. In no event or circumstance shall any of the Dentsply Group be responsible for any accident, damage to property, injury or death which may arise from the use of or receipt of the Prize.
5. ELIGIBILITY: The Contest is only open to Dentists who are Canadian residents and who have reached the age of majority in their province of residence at the time of entering the Contest, except employees, directors, officers, shareholders, consultants, agents and representatives of the Dentsply Group as well as any persons who are immediate family (defined as parents, children, siblings and/or spouse) of any such persons and/or any persons living in the same household as any of the aforesaid persons, all of whom are not eligible to enter or participate in this Contest.
6. ODDS OF WINNING; LIMIT ON ENTRY; LIMIT ON PRIZE:
Odds of winning depend upon the total number of eligible entries received.
Limit one (1) entry per PIN Number. Limit one (1) Prize per person or household.
7. SUBSTITUTION OF PRIZE: Each Prize shall be accepted as awarded and may not be exchanged by the selected entrant/winner for any amount of money or for any other prize. A Prize may not be substituted nor transferred by the selected entrant/winner. If requested by Dentsply, the selected entrant/winner must produce valid identification at the time that he/she is awarded the Prize. Dentsply reserves the right to substitute the Prize or any Prize component with another of comparable or greater value. If the selected entrant/winner refuses to accept the Prize as awarded, the selected entrant/winner shall forfeit the Prize and Dentsply Group shall be automatically released of any and all obligations to the selected entrant/winner. Dentsply shall arrange for the Prize to be delivered to the selected entrant/winner at his/her dental office in Canada.
The Prize must be used by the winner within 12 months from the date that he/she is notified that he/she has won the Prize, otherwise the winner shall forfeit and waive his/her right to the Prize.
8. GENERAL TERMS AND CONDITIONS:
The Dentsply Group shall not be liable for any loss or damage caused directly or indirectly by technical difficulties or errors in the administration of the Contest or acts of God or any other matter outside of their control which may affect the conduct of the Contest.
The Dentsply Group assumes no responsibility for lost, delayed, misidentified or misdirected entries. In addition, the Dentsply Group assumes no responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed, stolen, destroyed, altered or garbled data or transmissions, errors, omissions, interruptions, deletions, defects or failures of any telephone or computer line or network, computer equipment, software, email, computer online systems or servers, players, browsers, traffic congestion on the internet or at any website or any combination thereof, whether originating from sender or recipient. Entry materials/data that have been tampered with or altered are void.
Only a person declared by Dentsply to be the selected entrant will be entitled to the Prize, subject to the selected entrant's eligibility for this Contest and his/her compliance with these Contest rules. By participating in this Contest, participants agree to be bound by these rules. In the event of any disagreement as to whether a person is eligible as a contestant, or as to the qualifications of the selected entrant, the decision of Dentsply shall be final. All decisions with respect to all matters relating to the Contest shall be made by Dentsply or its representatives and any such decisions shall be final and binding in all respects and there shall be no rights of appeal with respect to any such decision or the Contest. Participants may be disqualified if they do not comply with the Contest rules. Dentsply reserves the right to terminate the Contest or to modify the Contest rules as necessary for any reason, without notice, including, without limitation, in order to comply with any applicable law or policy or in the event that the Contest is not capable of being conducted as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of the Contest. If for any reason the Contest is not capable of being completed as planned including, but not limited to computer virus, bugs, tampering, technical failures or other causes beyond the control of any of the Denstply Group, Dentsply reserves the right to cancel, suspend or modify the Contest.
Any attempt by a participant, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Dentsply reserves the right to seek remedies and damages from any such individual or person, to the fullest extent permitted by law, including criminal prosecution. A participant engaging in any of the foregoing activities may be disqualified and will forfeit any Prizes awarded.
This Contest is subject to all applicable federal, provincial and municipal laws. The Contest is void in every jurisdiction where it is prohibited or restricted by any law, statute or other appropriate authority. Dentsply does not warrant that this Contest may be entered into legally in any particular jurisdiction. All entries and submitted material will become the property of Dentsply and none will be acknowledged or returned. Taxes and any other costs or expenses relating to this Contest or any Prize awarded, if any, are the sole responsibility of the selected entrant.
The Dentsply Group shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest, including but not limited to any damage to a participant's computer equipment, computer system, software or any combination thereof, as a result of the participant's participation in this Contest. Each entrant hereby acknowledges and agrees that the Dentsply Group shall not be responsible for nor bear any liability for the loss, theft or misuse of the Prize. Each entrant further acknowledges and agrees that the Dentsply Group shall not be responsible for nor bear any liability for any property damage, personal injury or misfortune in any way attributable to this Contest, the Prize or the entrant's participation in this Contest.
By entering this contest, participants consent to the collection and use of their personal information (information that identifies them as an individual, for example, home telephone number, age and home address, etc.) collected on the registration or entry form by Dentsply for the following purposes and uses:
- to administer the Contest;
- to extend promotional offers, literature and materials to the participant regarding Dentsply, its subsidiaries, related and affiliated companies, and their products and/or services;
- to analyze sales information and data;
Participants consent to the use of their names and likeness for advertising and publicity purposes by Dentsply and its affiliated and related companies, without additional compensation, unless prohibited by law. Each winner authorizes the Dentsply Group to broadcast, publish and disseminate their name, photographs, likeness and voices, in connection with any promotion or publicity, and/or for general news and information purposes at no compensation to the winners.
No correspondence or notice with respect to this Contest will be provided to entrants except the selected entrant who will be contacted by mail or phone.
For contestants who are residents of Quebec, any litigation respecting the conduct or organization of the Contest may be submitted to the Regie de alcohols des courses et des jeux for a ruling. For contestants who are residents of Quebec, any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.

This Contest is governed by and shall be interpreted in accordance with the laws of Canada.
